Apple Strikes Settlement with Brazilian Antitrust Authority, Paving the Way for Third-Party App Stores

On December 23, the Administrative Council for Economic Defense (CADE), which serves as Brazil's antitrust regulatory authority, released a statement. The statement announced that, through a majority vote, CADE had given its approval to the Termination Commitment Terms (TCC) put forward by Apple. These terms are a crucial component of an ongoing administrative investigation that focuses on examining whether Apple has engaged in potentially anticompetitive behaviors within Brazil's iOS digital ecosystem.

As stipulated in the terms, Apple will grant app developers the freedom to actively promote external offers. Moreover, developers will be able to guide users towards conducting transactions outside the confines of the app. Additionally, alternative purchasing methods will be made available to users within the app itself. On the very same day, Apple made an official announcement, stating that it had successfully reached a settlement with CADE. As part of this agreement, Apple consented to permit third-party app stores to operate on iOS systems within Brazil. This development effectively brings an end to the three-year-long antitrust investigation.
