Court filings reveal that BYD has taken legal action against the U.S. government, contesting the Trump administration's extensive use of authority to levy tariffs and requesting a reimbursement for all tariffs paid since April of the previous year. This action represents the inaugural lawsuit brought forth by a Chinese automotive manufacturer concerning U.S. tariff matters. BYD's four American subsidiaries lodged the lawsuit on January 26, asserting that the International Emergency Economic Powers Act does not grant the authority to impose border taxes. In pursuit of tariff reimbursement, BYD has filed an additional complaint. Presently, BYD's U.S. operations encompass sectors such as passenger buses, with its North American branch employing 750 individuals at its California manufacturing facility.
