On October 16th, in response to inquiries about whether the global expansion of large-scale artificial intelligence (AI) models is subject to technology export regulations following the implementation of the Catalogue, relevant authorities clarified that the “going-global” initiatives for large-scale AI models and their application products take various forms. The pivotal factor in determining whether such initiatives fall under technology export controls is whether they involve the transfer of restricted technologies from China to overseas entities. The scope of AI technologies regulated by these measures is both precise and limited. After implementation, the majority of AI technologies remain freely exportable. For technologies classified as restricted, if they are deployed locally overseas, they fall within the purview of technology export management. However, if deployed in controlled environments, such as overseas self-owned clouds, streamlined procedures like automatic licensing can be facilitated. Nevertheless, if enterprises utilize restricted large-scale models to offer API access, APP or web interactions, SaaS applications, or lightweight local deployments, these activities do not constitute large-scale model technology exports and are thus not subject to export control regulations.
