The incident occurred in 2019, and in August 2025, the jury found Tesla 33% responsible, awarding $43 million in compensatory damages and $200 million in punitive damages. The Attorneys General of the three states argue that the punitive damages are excessively high and fail to comply with Florida's statutory cap, requesting the verdict be overturned or the punitive damages reduced. Additionally, it was revealed that Usmaier's fundraising committee received political donations linked to a Tesla lobbying firm prior to submitting the brief, sparking controversy.
