On November 14, Reuters reported that on Thursday (local time), a U.S. federal judge turned down the requests from Apple Inc. and OpenAI to have a lawsuit dismissed. The judge decreed that both firms are obligated to respond to the lawsuit initiated by Musk's xAI. The lawsuit contends that Apple and OpenAI unlawfully colluded to monopolize the markets for smartphones and generative AI chatbots. Back in August of this year, xAI formally lodged the lawsuit, asserting that Apple's exclusive embedding of ChatGPT into the iPhone, its manipulation of App Store rankings, and its preferential treatment of OpenAI have obstructed fair competition. Both Apple and OpenAI have refuted these claims, emphasizing that their collaboration is non-exclusive. Nevertheless, the judge has mandated that both parties furnish additional documentation to elucidate their stances.
