Tesla has recently initiated legal action against the California Department of Motor Vehicles (DMV), aiming to overturn a decision by the department that accused the company of breaking the law through misleading statements regarding the self-driving capabilities of its vehicles. Earlier, the California Office of Administrative Hearings concluded that Tesla had engaged in deceptive marketing practices, leading the DMV to require modifications to Tesla's promotional content. Tesla has since made the necessary changes. Nevertheless, Tesla is seeking additional concessions from the DMV, asserting that the evidence is insufficient to label terms such as "Autopilot" and "Full Self-Driving" as deceptive marketing. Currently, Tesla has rebranded some of its automated driving assistance features and now exclusively offers them through a subscription service. Elon Musk had previously vowed that Tesla vehicles could be upgraded to function as robotaxis, but this promise has yet to materialize. Tesla's future prosperity largely depends on its capacity to develop a genuinely autonomous driving system. For several years, Tesla's marketing has fostered a public perception that its systems can be used safely without the driver's undivided attention. However, the vehicle's user manual clearly states that drivers must stay alert and focused on the road when utilizing these features. The DMV highlighted that Tesla's marketing incorrectly implied that the vehicles could operate completely autonomously, whereas Tesla's legal team argued that consumers are informed during the purchase process that the features do not provide full self-driving capability. Furthermore, customers who bought the FSD feature have requested refunds, and Tesla was mandated to pay $243 million in damages for a fatal accident caused by its Autopilot system.
