On September 16 (local time), the U.S. International Trade Commission (ITC) declared the launch of a 337 investigation (No. 337 - TA - 1521) concerning certain electronic devices that utilize specific audio technologies. The targets of this investigation are Apple, Samsung Electronics, its U.S. subsidiaries, and Google. This investigation is triggered by a complaint lodged by BoomCloud 360 Inc. on August 14, 2026, which was further supplemented on August 31. The complaint alleges that when the relevant devices are imported and sold in the United States, they infringe upon the company's patents, thus violating Section 337 of the U.S. Tariff Act of 1930. The complainant has put forward a request for the issuance of a limited exclusion order and a cease - and - desist order. The ITC clarified that the initiation of an investigation does not mean that there has been a determination of patent infringement. The case will first be heard and initially ruled upon by an administrative law judge. After that, a final decision will be made following a review by the ITC. Within 45 days of the case being filed, the ITC will establish a target date for the completion of the investigation. Any relief orders issued will come into effect immediately and will become final after 60 days, unless they are vetoed by the U.S. Trade Representative due to policy considerations.
