European Commission Makes Preliminary Decision: AWS and Azure to Be Designated as 'Gatekeepers' Under the Digital Markets Act, Bringing Amazon and Microsoft Under Closer Watch

On June 25, the European Commission made a preliminary announcement that it had identified Amazon Web Services (AWS) and Microsoft Azure as 'gatekeepers' in accordance with the Digital Markets Act (DMA), and had duly notified the two tech giants. Although AWS and Azure fall short of the quantitative criteria outlined in the DMA, the Commission holds the view that they are, respectively, the largest and second-largest cloud computing services in the EU. These services act as vital conduits for businesses to connect with their customers. The European Commission is set to launch a market investigation into these two cloud services on November 18, 2025. It's worth noting that Amazon and Microsoft have already been named as DMA gatekeepers for their other services in the past. Should their cloud services be included this time around, the extent of compliance obligations for both companies within the EU will see a further expansion.
