The Munich Regional Court has recently handed down a ruling stating that Google must assume direct legal responsibility for any false statements found in its AI Overviews. The court determined that, in contrast to traditional search results, AI Overviews constitute Google's proprietary content. When addressing user queries, the AI Overviews erroneously associated two publishers with fraudulent activities and other forms of misconduct. These pieces of misinformation were entirely fabricated by the AI and did not appear in any of the linked sources. The publishers had previously requested that Google put an end to the infringement, but their plea went unanswered. Consequently, the court ruled that Google should be liable for 80% of the litigation costs.
