On November 11, the Munich Regional Court handed down a ruling stating that OpenAI's chatbot, ChatGPT, had breached German copyright law by reproducing the lyrics of German musicians, including Herbert Grönemeyer. The crux of the legal dispute centers on the legality of OpenAI's utilization of lyrics to train its language model. In 2024, the German Music Copyright Society, GEMA, initiated a lawsuit, alleging that ChatGPT had copied and disseminated copyright-protected lyrics without obtaining the necessary permissions. Moreover, GEMA claimed that ChatGPT was even capable of generating original lyrics while operating offline, leading to the conclusion that it must have employed GEMA's copyrighted works for training purposes. Additionally, when ChatGPT undergoes what are termed 'hallucinations' and modifies lyrics, it encroaches upon the moral rights of the original authors.
