Recently, the Dongguan Intermediate People's Court has reached a verdict in a personal injury liability dispute case stemming from a fire caused by thermal runaway during mobile phone charging. On the early morning of February 4, 2024, in a rented room in Dongguan, Guangdong Province, a woman, identified by her surname Chen, was using her phone while it was charging in bed and inadvertently fell asleep. The phone's battery underwent thermal runaway and ignited, causing severe burns across her body, which resulted in two sixth-degree disabilities and one ninth-degree disability. An inquiry established that the fire was directly caused by the thermal runaway of the phone's lithium battery. Ms. Chen filed a lawsuit against the phone seller, the house's landlord, and the sub-landlord, seeking compensation exceeding RMB 1.18 million. The court's final ruling assigned 40% responsibility to Ms. Chen, with the phone seller bearing 60% of the liability, equating to RMB 634,511.35 in damages. The sub-landlord was directed to assume a 10% supplementary liability for the portion of the debt that the seller was unable to pay. The court clarified that victims suffering from product defects have the right to seek compensation from either the manufacturer or the seller, and sellers can pursue reimbursement from manufacturers after accepting liability. The court also cautioned the public against using electronic devices while they are charging, urged sellers to rigorously control product quality, and underscored that landlords should fulfill their fire safety obligations.
