Apple Petitions U.S. Supreme Court to Stay Enforcement of Ruling in Epic Litigation

On May 4 (local time), Apple Inc. submitted a petition to the Supreme Court, requesting a stay of enforcement of an order issued by the Ninth Circuit Court of Appeals. Earlier, on April 28, the appellate court reversed the initial judgment, mandating Apple to return to the lower court to renegotiate the commission rates applicable to developers who direct users to utilize third-party payment channels. In 2021, the court had already directed Apple to loosen its anti-steering restrictions. Despite Apple's compliance, it continued to impose substantial fees, resulting in a finding of contempt. Apple contested this decision, asserting that the contempt designation was unwarranted since the injunction did not explicitly address App Store fee structures, and such a designation adversely affected its stance in the remand proceedings. Furthermore, Apple contended that the appellate court's decision conflicts with rulings from other jurisdictions and that there exists a likelihood that the Supreme Court will accept the case and reverse a portion of the ruling. Consequently, Apple argued that the litigation process should be halted. Apple underscored that it is not seeking to block the injunction itself and will refrain from imposing commissions on external purchases within the App Store during the course of the case. Therefore, suspending enforcement will not inflict immediate harm on Epic.
