The Cloud Infrastructure Services Providers in Europe (CISPE) has brought to the attention of Europe's second-highest court that the EU's antitrust authorities fell short in thoroughly evaluating the potential risks associated with the deal prior to sanctioning Broadcom's staggering USD 69 billion acquisition of cloud computing giant VMware. In July of this year, CISPE lodged a lawsuit with the General Court in Luxembourg, contending that the European Commission committed legal missteps and made blatant errors in judgment when gauging the transaction's influence on competition within the server virtualization software market. CISPE firmly holds the view that the European Commission's omission in assessing the transaction's market impact amounts to a legal misstep. Broadcom has vehemently refuted these claims. Meanwhile, a spokesperson for the European Commission affirmed the institution's readiness to defend its stance in court. The Secretary-General of CISPE asserted that regulatory oversight has inflicted tangible harm on Europe's cloud computing sector.
