On October 22, 2026 (local time), the U.S. Treasury Department released a notice updating its outbound investment security framework, proposing to add biotechnology to the list of sectors where investment is restricted. This framework currently imposes limitations on investments in five key areas: semiconductors and microelectronics, artificial intelligence systems, quantum information technology, high-performance computing and supercomputing, as well as hypersonic systems. These restrictions apply to countries including China, Russia, Iran, North Korea, and Cuba, with the overarching goal of preventing U.S. capital from contributing to the enhancement of these nations' military, technological, and intelligence surveillance capabilities. The newly proposed regulations will also encompass biotechnology, mandating that transactions involving "reportable technologies" be reported to the U.S. Treasury Department, barring transactions involving "restricted technologies," and clearly defining the technical parameters involved.
