US ITC Launches 337 Investigation into Seven Companies Including Samsung Electronics, Google, NVIDIA, and Broadcom

On July 15 (local time), the United States International Trade Commission (USITC) initiated a 337 investigation into certain DRAM devices, their downstream products, and components, with the investigation numbered 337-TA-1511. The investigation involves seven named respondents, including Samsung Electronics-related entities, Google, Supermicro, NVIDIA, and Broadcom. The investigation stems from a complaint and supplementary materials filed in June 2026 by Netlist, a memory technology company based in Irvine, California. Netlist alleges that the relevant products of these companies infringe upon two of its U.S.-registered patents and has requested the issuance of a limited exclusion order and a cease-and-desist order. Notably, there have been multiple legal disputes between Netlist and Samsung, with Samsung having been previously ruled to have infringed and ordered to pay a total of $421 million in damages. Additionally, Netlist filed another 337 investigation petition with the USITC in September 2025, which was subsequently accepted for case filing (docketed). A 337 investigation is a trade remedy measure targeting intellectual property infringement in imported goods. If infringement is determined, the USITC may issue an exclusion order to prevent infringing products from entering the U.S. market. Within 45 days after the investigation is docketed, the Commission will set a target date for completing the investigation. A remedy order will take effect 60 days after its issuance unless vetoed by the U.S. Trade Representative.
