USPTO Unveils New Guidelines for AI-Aided Inventions

On November 26, 2025, the United States Patent and Trademark Office (USPTO) rolled out new guidelines. These guidelines make it clear that inventions crafted with the help of artificial intelligence (AI) are eligible for patent protection, provided certain conditions are met. In the official notice, John Squyres, the Director of the Patent Office, emphasized that generative AI systems should be seen as tools that aid in the invention process, akin to laboratory equipment or computer software. Drawing from the Inventor Guidelines for AI-Assisted Inventions issued in February 2024, it's established that only natural persons can be acknowledged as inventors. AI systems are not permitted to be listed as inventors. Nevertheless, if a natural person makes a substantial contribution to an invention, they retain the right to apply for patent protection. Furthermore, the patent subject matter eligibility guidelines published in July 2024 offer illustrative examples. These examples are designed to assist in determining the patentability of inventions that incorporate AI technology.
