Prior to this, in 2020, the US Congress enacted the "Ban or Sell" Act, which was signed into law by President Biden. This act mandated ByteDance to either sell TikTok's US operations or face a ban. Notably, President Trump had previously granted TikTok three extensions and directed Apple and Google app stores to maintain TikTok downloads. Markey's bill suggests that TikTok should be permitted to continue operating in the US provided it maintains transparency in content moderation practices and ensures that US user data remains within US borders.
