The World Trade Organization (WTO) has rendered a decision in the dispute case between China and the European Union (DS611) concerning anti-suit injunctions of standard essential patents. The arbitral tribunal upheld the panel's ruling, affirming that China's anti-suit injunctions do not impede the protection of patent rights enjoyed by other WTO members and do not constitute an intellectual property measure subject to WTO regulations. While China welcomes this outcome, it expresses concern over the tribunal's expansion of member obligations without a clear rule basis. China will thoroughly review the ruling's content and handle it appropriately in accordance with WTO rules. Additionally, China remains committed to supporting the Multilateral Trade Agreements (MPIA) mechanism and upholding the multilateral trading system.
