The Ministry of Finance has recently issued a policy Q&A in response to the "Notice on Implementing Relevant Measures for Government Procurement of Medical Devices Imported from the European Union," clarifying the restrictions on the procurement of EU-imported medical devices. For government procurement projects of medical devices with a budget exceeding RMB 45 million, EU enterprises will be excluded from participation. Moreover, the share of EU-imported medical devices supplied by non-EU enterprises must not surpass 50% of the total contract value. However, EU-funded enterprises operating in China are eligible to participate, and their domestically manufactured products are not subject to these restrictions. Only in exceptional circumstances, where EU-imported products are indispensable to meet specific needs, will such procurement be considered, contingent upon technical justification. It is important to note that this policy does not extend to centralized procurement of pharmaceuticals and medical consumables; for specific items, reference should be made to the government procurement classification catalog. Additionally, products that have already completed import audits must still adhere to the provisions outlined in this notice. State-owned enterprises are not bound by this notice in their procurement processes. The financial sector will enhance oversight, and suppliers have the right to voice doubts or lodge complaints through legal channels.
