The second draft of the revised Anti-Unfair Competition Law is poised for deliberation, set to incorporate provisions aimed at enhancing the fair competition review system. These amendments will refine the definition of 'involutionary' competition on governance platforms and delineate the responsibilities of market supervision authorities. Furthermore, the draft will specify the obligations of platform operators, clarify standards for deceptive forms of unfair competition, and outline the elements constituting unfair competitive practices, including violations of data rights and malicious transactions. Notably, the draft also addresses the issue of large enterprises abusing their dominant position to delay payments to small and medium-sized enterprises, proposing stricter administrative penalties.
