On March 11 (local time), the US Securities and Exchange Commission (SEC) and the US Commodity Futures Trading Commission (CFTC) inked a Memorandum of Understanding, formally cementing a cooperative partnership between the two entities across various joint initiatives, including policies pertaining to crypto assets. This significant step brings to a close years of jurisdictional contention between these two pivotal US market regulatory agencies, which will now work in tandem to enforce a coordinated and unified regulatory approach towards the cryptocurrency market. Under the terms of the agreement, the SEC and CFTC are set to exchange data and resources, convene regular joint sessions, and harmonize their efforts in enforcement actions, product approvals, and policy interpretations. Furthermore, the two bodies will establish a regulatory framework tailored to crypto assets and other burgeoning technologies, simplify the regulatory reporting procedures for transactional data, funds, and intermediaries, and synchronize their cross-market reviews, economic analyses, risk monitoring, supervision, and enforcement endeavors.
