China's Regulations on the Protection of Integrated Circuit Layout Designs have been implemented for 25 years since their promulgation in 2001. With the rapid advancement of integrated circuit technology, significant improvements in integration and density, especially the widespread adoption of EDA tools, the original protection rules have struggled to meet current technological demands. In response, the State Council revised and promulgated new regulations on July 23, 2026, which will take effect on October 15, 2026. The new regulations reshape the domestic chip layout protection system by expanding protection boundaries, standardizing rights confirmation processes, increasing penalties for infringement, and improving market-oriented operational rules, providing robust legal support for technological innovation among integrated circuit enterprises.
