Supermicro Initiates Independent Inquiry into Incident Linked to Co-founder’s Indictment

On April 7, reports surfaced indicating that Supermicro, a prominent U.S. server manufacturer, had announced the commencement of an independent investigation, alongside an internal review of its global trade compliance program. This move comes in response to the indictment by the U.S. Department of Justice against three affiliated individuals, who are accused of breaching export control laws. Previously, Liao Yixian, the co-founder of the company, along with two other individuals, faced allegations of evading U.S. export control regulations. They were accused of shipping AI servers, which were equipped with NVIDIA's GPUs subject to regulation, to mainland China via intermediary companies in Southeast Asia. The total value of these transactions amounted to $2.5 billion. At present, Liao Yixian and contractor Sun Tingwei have been apprehended, while Zhang Ruicang, the sales manager in Taiwan, is still at large. All three individuals are confronted with charges that carry a potential prison sentence of up to 20 years. Supermicro clarified that the company itself is not a defendant in this case. It has suspended the individuals involved and severed ties with them, underscoring its stringent compliance system and unwavering commitment to collaborating fully with the ongoing investigation.
