On March 18, the United States Patent and Trademark Office (USPTO) once again rejected the Inter Partes Review (IPR) petition filed by Chinese display panel manufacturer Tianma Microelectronics against LG's U.S. patent. This rejection was not based on a technical assessment of the patent's validity but rather on procedural and policy considerations. The USPTO argued that Tianma's shareholders include the Aviation Industry Corporation of China, which holds approximately a 10% stake, leading to the conclusion that Tianma might be subject to 'foreign government influence.' Consequently, the Director exercised discretionary authority to dismiss the petition. This ruling means that Tianma has lost the avenue to challenge LG's relevant patents through the USPTO's administrative procedures.
