Ministry of Commerce: Imposing Export Controls on Select Rare Earth Products for Overseas Shipment

The Ministry of Commerce has released an announcement stipulating that overseas entities and individuals (designated as specific overseas exporters) must secure a dual-use item export license from China's Ministry of Commerce prior to exporting certain products to nations and territories beyond China's borders. As a general rule, export requests directed at overseas military end-users, as well as importers and final users (inclusive of their subsidiaries, branches, and other associated entities with a controlling interest of 50% or greater) listed on the Export Control Management List and the Watch List, will face rejection. Applications for exports intended for end-uses encompassing the research and development, and production of logic chips with a feature size of 14 nanometers or less, memory chips with 256 layers or more, along with the production and testing apparatus and materials required for fabricating these chips, or the development of artificial intelligence technologies with possible military applications, will undergo individualized assessment.
