On September 5, 2025, NVIDIA declared that the proposed "Guaranteeing Access and Innovation in National AI Act" (AI GAIN Act) would impose limitations on the worldwide distribution of cutting-edge AI chips. This, in turn, would have a detrimental effect on the United States' technological leadership and its economic landscape.

As an integral component of the National Defense Authorization Act, this bill mandates that manufacturers of AI chips give precedence to fulfilling domestic orders within the United States before catering to overseas clients. The legislation establishes rigorous benchmarks, encompassing Total Processing Performance (TPP) scores, Performance Density (PD) metrics, and bandwidth prerequisites. Notably, chips with a TPP exceeding 4800 are prohibited from being exported.

A spokesperson from NVIDIA highlighted that although the intention behind this measure is to safeguard the interests and requirements of the United States, it will ultimately erode the global industrial competitiveness.
