On October 1, California Governor Gavin Newsom (Democrat) signed bill AB 1883 on Wednesday, prohibiting California businesses from collecting employees' brain activity data or using AI monitoring tools to infer employees' emotions. The bill restricts employers from using video and audio surveillance, work hour trackers, geolocation, and electromagnetic tracking systems if these systems utilize AI to collect neural data or identify employees' emotions. The new law stipulates that violations may result in civil penalties of up to $500, with enforcement by the state labor commissioner and public prosecutors.
