The Supreme People's Court has rolled out the Opinions on the Lawful Adjudication of Disputes Involving Artificial Intelligence, delineating three key provisions to fortify the protection of people's livelihood rights and interests. Firstly, it bolsters judicial safeguards for personality rights, explicitly defining the liability for AI-driven infringements on personality rights, including the right to one's portrait. Secondly, it shields personal information rights, specifying that the reasonable processing of information, which has been lawfully disclosed and not expressly rejected by individuals for AI model training, is generally not deemed an infringement. Nevertheless, if such processing substantially affects individual rights, personal consent becomes imperative. Thirdly, it curbs practices such as 'big data price discrimination' and 'AI-powered celebrity impersonation in product endorsements.' It clarifies that operators employing algorithms to engage in unreasonable differential treatment will be held accountable. Moreover, in cases where AI is fraudulently used to impersonate celebrities for product endorsements, consumers' demands for punitive damages will be upheld.
