Have you noticed any 'digital employees' in your workplace? When a job is taken over by AI, can a company fairly dismiss employees, citing 'significant changes in objective circumstances' as the reason? This question sparked heated debate among trade union members during this year's Two Sessions in Shanghai.

The Beijing Municipal Human Resources and Social Security Bureau once shared a telling case: A tech company ended its labor contracts with employees, arguing that its operations had fully transitioned to AI-powered automated data collection, rendering their departments and positions obsolete. However, after examining the case, the labor arbitration commission concluded that the company's adoption of AI technology was a proactive innovation initiative. While such advancements may lead to job structure adjustments, they do not meet the criteria of being unavoidable or unpredictable—key elements of 'objective circumstances.' Essentially, the company was transferring the risks of technological progress onto its employees.
