As artificial intelligence (AI) technology continues to evolve, the question of copyright for AI-generated works has become a hot - button issue, drawing extensive public attention. On November 3, the Jinshan District People's Court in Shanghai handed down a verdict in what was the city's inaugural copyright infringement lawsuit involving an AI large - scale model.

The defendant, Mr. Li, sourced images of the Medusa character from the novel Battle Through the Heavens through a specific platform. He then compiled these images into a package and utilized them to generate two new Medusa LoRA models. The plaintiff company asserted that Mr. Li's actions violated its rights of reproduction and adaptation, and also amounted to unfair competition. It demanded that Mr. Li halt the infringement, mitigate its adverse effects, and pay a hefty compensation of 2 million yuan.

In his defense, Mr. Li contended that the 'Medusa' character was not an original creation and that the platform had already implemented suitable measures. The court, after careful deliberation, held that the name 'Medusa' lacked the distinctive qualities required for protection as a commodity name.

In the end, the court ruled that Mr. Li must cease all infringing activities. He was also ordered to compensate the plaintiff for economic losses amounting to 30,000 yuan and cover legal expenses of 20,000 yuan. Additionally, the court dismissed the plaintiff's other claims. This landmark judgment lays a crucial legal foundation for future AI - related creative endeavors and copyright protection.
