The Ministry of Industry and Information Technology, in collaboration with seven other key departments, has formally unveiled the "2026 Edition Guidelines for the Security of Cross-Border Automobile Data Transfer." These guidelines mandate that automobile data processors must initiate security assessments for cross-border data transfers through domestic legal entities. In scenarios where a domestic legal entity is absent, the responsibility falls on a domestic branch to submit the application. For groups with multiple domestic subsidiaries operating in similar business environments, the parent company has the option to consolidate their applications into a single submission. The guidelines explicitly forbid the fragmentation of data sets for the purpose of circumventing assessment procedures. Processors are tasked with conducting thorough self-assessments, promptly addressing any identified issues in compliance with regulatory standards, and submitting all necessary documentation to the cyberspace administration authority. Data transfer activities can only commence after a successful assessment. Furthermore, in the event of any security-related developments, a fresh application must be promptly submitted for review.
