DoorDash, Grubhub, and Uber Eats have reached a settlement with the City of New York concerning a regulation that capped delivery fees. Enacted in May 2020, the regulation imposed a 15% limit on delivery fees and a 5% cap on advertising and other service fees. The settlement agreement, submitted to the federal court in Manhattan, permits these food delivery services to charge fees exceeding the statutory limits under specific circumstances. Initially enacted to shield the pandemic-stricken restaurant industry, the regulation was made permanent in August 2021, leading to legal challenges from the delivery companies.
