Based on court filings, Apple has made an application to an Indian court, seeking to prevent the nation's antitrust authority from gaining access to its worldwide financial records. This action forms part of an inquiry into Apple's App Store policies, with Apple additionally casting doubt on the legitimacy of pertinent legal clauses. At present, Apple is entangled in a legal tussle with the Competition Commission of India (CCI). The CCI has leveled accusations against Apple, alleging that it has misused its dominant market position in the App Store—a claim that Apple refutes. Apple is apprehensive that if the CCI were to impose fines calculated on the basis of global revenue, it could be liable for penalties amounting to as much as $38 billion. Apple has already initiated legal proceedings in the Indian court concerning the 2024 fine regulations, and the matter is still pending review. Despite this, the CCI is forging ahead with its investigation and, on December 31, issued a request to Apple for the submission of financial data. Apple has submitted a petition to the Delhi High Court, urging it to halt the investigation, contending that being compelled to comply would render its principal lawsuit devoid of purpose. The CCI, in contrast, has justified the new regulations as an essential step to deter infractions by multinational enterprises. The Delhi High Court is set to deliberate on the case on January 27.
