During a seminar organized by the Japan Computer Software Copyright Association, Koji Nishiura from Nintendo shed light on the legality of emulators. He emphasized that emulators, in their essence, are not inherently illegal but rather, the manner in which they are utilized can lead to infringement. Specifically, an emulator that solely mimics hardware functionalities might fall within legal boundaries. Conversely, if an emulator duplicates device programs or circumvents encryption, it could be deemed illegal. Nintendo DS R4 cards, for example, are considered unlawful due to their bypass of security measures. Similarly, emulators offering pirated game downloads are in clear violation of copyright laws. Recently, Nintendo has achieved notable success in combating multiple Switch emulators, further reinforcing its commitment to intellectual property protection.
