The Advocate General of the Court of Justice of the European Union has issued an opinion in a case brought by a Hungarian website operator against Google, finding that Google's Gemini chatbot may, under certain circumstances, violate copyright rules when using news reports. Specifically, it may infringe publishers' reproduction rights if it illegally bypasses paywalls to obtain content, or if it reuses the specific expressive form of news reports in an identifiable manner in its answers. However, copyright rules do not protect mere facts in news—only the specific expressive form of those facts. Moreover, the existing text and data mining exception permits the use of copyright-protected materials to train large language models. This opinion is not legally binding but is usually referenced and adopted by judges. If the court ultimately rules against Google, it could create new survival opportunities for relevant online media, alleviating the decline in media traffic caused by AI chatbots generating news summaries and replacing traditional search results with external links.
