On October 30, the head of the Department of International Trade and Economic Affairs of the Ministry of Commerce provided an interpretation of the Protocol on the Upgrading of the China-Switzerland Free Trade Agreement. A new chapter has been added in the area of digital trade. Both sides have committed not to impose tariffs on electronic transmissions, to enhance personal information protection, to enable digital customs clearance to reduce transaction costs, and to cooperate in fields such as artificial intelligence and electronic bills of lading. For the first time, the agreement includes special provisions on source code protection, marking a significant breakthrough in the development of China's digital trade rules. It also incorporates non-discriminatory rules for telecommunications infrastructure, representing the first time China has reached such an institutional arrangement with a European country.
