On August 20, the State Administration for Market Regulation disclosed six notable cases involving trade secret violations. Among these, the case concerning Mr. Sun's infringement of trade secrets related to an AI large model, which was investigated by the Hangzhou Municipal Market Supervision Bureau in Zhejiang Province, garnered considerable attention. This case represents the country's first instance involving trade secrets pertaining to a specialized AI large model, overcoming the constraints of traditional law enforcement within the AI sector. Traditionally, the protection of AI intellectual property has been primarily centered on the confirmation of source code rights. However, this case has shifted away from the industry's previous 'code-centric' mindset, bringing law enforcement practices more in line with the unique characteristics of the AI industry. It clarifies that integration solutions based on natural language and non-standard operational rules can independently constitute trade secrets. The investigation into this case has pioneered a method for identifying trade secrets in AI non-standard integration technologies, addressing a gap in domestic law enforcement in this domain. It has established compliance benchmarks for the movement of algorithm talent, AI research and development among competitors, and the management of confidential data within technology innovation firms. Consequently, this has fostered the standardized and innovative growth of the AI industry.
