On the afternoon of November 6, the Huangpu District People's Court in Shanghai handed down a first - instance judgment in what marks Shanghai's first - ever copyright infringement case concerning AI prompts. The court clarified that the six sets of prompts under scrutiny served as instructions or descriptions that directed AI to create particular images. Although these prompts could potentially reflect creative intentions, they failed to showcase a personalized intellectual endeavor. As a result, they should not be regarded as works in the legal sense. Consequently, the plaintiff does not possess copyright over these prompts and lacks the grounds to allege infringement. Ultimately, the court rejected all of the plaintiff's claims.
