AI Impersonates CCTV Host in Product Promotion: Beijing Handles First AI-Related False Advertising Case

Recently, Beijing's market regulatory authorities have taken action on the first instance of false advertising involving the use of AI technology. In February of this year, the Market Supervision Bureau of Haidian District in Beijing received a consumer complaint. The complaint alleged that a company based in Beijing was engaging in false promotion of its 'Deep-Sea Polyene Fish Oil' product through video platforms, asserting that the product could cure a variety of diseases.

Upon conducting a thorough investigation, authorities discovered that the product in question is, in fact, an ordinary food item that possesses no disease-curing properties. Moreover, the image of the host featured in the promotional video was artificially generated using AI technology, rather than being a real person. This deceptive practice clearly runs afoul of the relevant provisions outlined in the Advertising Law of the People's Republic of China. As a result, the company has been subjected to administrative penalties.
